DEFINITION OF SEXUAL HARASSMENT

 (1)Quid pro quo harassment

(2)Unwelcome conduct determined by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the recipient’s education program or activity

(3)Sexual assault, domestic violence, dating violence, and stalking as defined by the CleryAct 34 CFR §106.30(a)

SCOPE OF JURISDICTION

Must occur within the United States

Must occur within the scope of an educational program or activity

“…locations, events, or circumstances over which the recipient exercised substantial control over both the respondent and the context in which the sexual harassment occurs…”  34 CFR §106.44(a)
